General Business Terms and Conditions - The purchase order of Blue Engineering s.r.o., the Internet shop operator, is in full compliance with the applicable Czech legislation and with the usual business practices in the Czech Republic. These GTCs apply to all online stores operated by Blue Engineering s.r.o. in any language mutation. All offered goods come from proven importers or distributors in the Czech Republic, meet all the required legal conditions, are of standard quality and are provided with a full warranty according to the valid legal regulations. Site visitors are aware that the content of the website in any language version is informative only. Purchase on sites operated by Blue Engineering s.r.o. are governed exclusively by the law of the Czech Republic and the products are primarily provided with information in the Czech language.

2. Order goods

Sending an internet order of selected goods the customer confirms the validity of the orders and agrees with the terms of an Internet portal www.blueengineering.cz i www.shop.blueengineering.cz. If the customer when the order is filled in correctly initials in electronic form or to register, he will be on the e-mail address receive a copy of the order as confirmation of registration of the order to the order of the e-shop. Upon registration, the customer will also be sent a login and password for any other purchases in e-shop and check order. If there is no copy of the order to the specified email address as soon as possible, please contact us. You can also order goods by phone or e-mail. If between sending an order confirmation and a change in prices, ordering has the right to withdraw from the order or accept the price change. The order is considered binding for both parties since its confirmation by the supplier. The order confirmation is ordering informed by email or phone. Goods of price action (product name has the word ACTION) will not provide additional discounts. Discounts can not be added and combined. Seller reserves the right to contact the customer by telephone to verify or clarify the order as such. Terms of higher order, some missing or inaccurate data and so on.

2.1

Each new order is binding (Civil Code § 1724 et seq., Act no. 89/2012 Coll.), According to our terms and conditions. If the consignment, order will be sent to the customer picked up on delivery, will in any case required to pay the costs incurred in sending goods and handling fee (a penalty) of 500, - CZK. By submitting your order, you agree to our terms and conditions and contractual fine in this amount. The receipt, processing and shipping orders, the buyer is informed by email mentioned in the order or by SMS to a mobile phone number. On the rationale for non-acceptance or rejection of the consignment (eg. Not received invitation from the deliverer, unordered merchandise, vacation, trip abroad, etc.) Will not be taken into account. Identification of the customer is possible through IP and ISP providers. The consumer has the right within 7 days from the return shipment actively ask to resend goods ordered. The consumer also pays the cost of an order prior vain postage. Method of payment of such an order will always advance payment to a bank account. In this case, a penalty will be charged. If the buyer requests within 7 days from the return shipment to resend the ordered goods or sending refuses, it will be issued a call for payment of the cost of shipping the consignment, including contractual penalties. In the case of non-payment of the amount owed, the claim will be dealt with legally.

2.3

If entering multiple orders from the same buyer within a time period which falls on the same date of dispatch of the orders, the seller reserves the right to combine because of efficiency and economy, all these orders into one. For the same buyer orders are considered orders placed with the same manner of delivery or delivery to the same address and one common information, such as: name, telephone or email.

3. The cancellation of the order

3.1 Cancellation of the order by the purchaser

The order can be canceled via phone or e-mail if the state orders received, there was no confirmation of the order and the goods were not shipped. In case of later cancellation, the operator of the portal www.blueengineering.cz and www.shop.blueengineering.cz claim for damages, especially of documented costs related to the shipment of goods.

3.2 Cancellation of the order by the seller

Shop operator has the right to cancel the order or its part in the event that the goods ordered during the order process ceases to produce or supply the Czech market, or to substantially modify its price. The cancellation of an order the customer will be informed. If you already have the value of goods ordered in canceled orders paid, it will be refunded the relevant amount as soon as possible.

4. Delivery of goods

Goods in the online store marked as "In Stock" are either in the warehouse or in an external warehouse. If the goods are in the shipping warehouse, it is shipped by default the next working day from the receipt of the order. If the goods are in stock in an external warehouse, then the expedition time is extended by 2-3 working days. If the goods are on order, then the shipping time is extended depending on when the supplier or importer delivers the goods. Usually within 14 days of ordering. The customer is always informed about the exact delivery time by phone or email. If the goods are not in stock, we cannot guarantee any deadline because it depends on other suppliers and importers. Upon receipt of the goods, the customer is obliged to check that the shipment is not showing any obvious signs of damage. If the shipment is damaged, the buyer is entitled to refuse the shipment, or find out the degree of damage in the presence of the carrier and then file a claim with the carrier, which is possible within three days of receipt of the shipment. The rejected shipment will be replaced by a new shipment as soon as possible. The place of delivery of the goods is the address indicated by the buyer in the order as the delivery address. For environmental reasons, tax documents (simplified tax documents or invoices) are only issued upon request (please state 'Request tax document' in the order note) or can be sent by e-mail. Shipments are sent via carriers or it is possible to pick up the order in person. more detailed specification of delivery method.

5. Payment methods

Bank transfer - only when sending goods. Delivery time starts on the date the payment is credited to our bank account.

Cash payment - upon receipt of goods at the branch.

5.1 Overpayments

Any overpayment incurred by the customer up to the amount of CZK 100 (or the equivalent in a foreign currency) is reserved by the e-shop operator to retain as a credit until the next order. Overpayments over CZK 100 (or foreign currency equivalent) will be returned at the customer's request. Overpayments will be sent free of charge by domestic bank transfer in CZK. If sent in a different way, such overpayments will be reduced by transaction fees (eg foreign currency conversion, foreign bank charges, flat fee for sending a C postal order of CZK 100, and others).

6. Rights of defective performance

The rights and obligations of the parties regarding the rights of defective performance shall be governed by the relevant legislation (including the provisions of §§ 1914-1925, §§ 2099-2117, and §§ 2161-2174 Law no. 89/2012 Coll., Civil Code).

Seller shall be liable to the consumer that the matter on receipt no defects. In particular, the seller is liable to the consumer at the time when the consumer over the case,

- Thing has qualities that the parties have agreed, and the absence of agreement, those qualities which the seller or manufacturer has described or which buyers expect given the nature of the goods and based on advertising they carry,

- The matter suitable for the purpose for which its use vendor lists or to which this kind of thing normally used,

- Corresponds to the quality or thing performing the agreed sample or template, if it was quality or performance determined in accordance with the agreed sample or model,

- That in the corresponding quantity, measure or weight and

- The thing meets the requirements of the legislation.

Unless the thing above mentioned features, the consumer may require the supply of new things without defects unless due to the nature of the defect unreasonable, but if the defect affects only part of the things consumers can request a replacement part; if this is not possible, it can withdraw from the contract. If, however, due to the disproportionate nature of the defect, especially if the defect can be removed without undue delay, the consumer is entitled to a free remedy. The right to deliver new things, or replace parts of the consumer in the case of removable defects if the matter can not be properly used for recurring defect or for a larger number of defects. In this case, the consumer has the right to cancel the contract.

If the consumer withdraws from the contract or does not apply if the right to deliver new things without defects, to replace its parts or repair things may request a reasonable discount. The consumer has the right to an adequate discount even if the seller can not deliver his new thing without defects, replace the part or thing to fix, and if the seller has not remedied within a reasonable time, or that the remedy seemed significant inconvenience to the consumer. If the consumer is entitled, at defects can be removed for repair or supplement what is missing, or a reasonable discount from the price, and irremovable defects for which it is not a thing to use, the right of withdrawal, or at a reasonable discount from the price, it belongs to him reimbursement for expenses incurred in the exercise of this right.

Right of defective performance does not belong to the buyer if the buyer knew that the thing has a defect, or if the buyer itself caused the defect.

The consumer is entitled to exercise the right of defect that occurs in consumer products during the twenty-four months after the takeover. When manifest defect within six months after the takeover, it is considered that the case was defective at the time of the takeover. If at selling things on its packaging, the instruction manual attached to things or in advertising, in accordance with other laws and regulations specify the period during which the case may be applied, the provisions on the guarantee for quality (eg. Discount due to a shorter minimum period durability).

6.1 Warranty and Returns

All offered goods come from proven importers or distributors, are of standard quality and are fully guaranteed according to valid legislation. The warranty does not cover defects caused by unauthorized interference, due to the use of goods for other than intended purposes, improper storage, improper handling, mechanical damage not caused by wear and tear caused by normal use, natural disasters or force majeure. The guaranteed properties of the goods fully depend on the specifications given directly by the manufacturer. Racing parts, as highly specialized products that are not intended for normal road traffic, cannot be guaranteed due to high effort.

To facilitate the complaint process, we recommend that you contact the customer line before sending the goods for complaint: +420 702 146 836, our staff will inform you of all the requirements of the correct complaint procedure. You can also send the claimed goods to the registered office of the company in accordance with the law. In such a case, send the goods as a registered shipment (eg: courier, Czech Post, Handheld Service or Recommended Parcel) so that the shipment can be claimed if it is lost or damaged. Our online store assumes no liability for damage caused by insufficient or no insurance of the goods during shipment from the customer. The costs related to the transportation of goods for the purpose of claiming the goods shall be borne by the consumer (customer) and will be reimbursed to the seller only if his claim is recognized as justified. Do not send the shipment with COD - shipments sent by COD customers will not be accepted by Blue Engineering s. r. o.

6.1.1 Complaint procedure

Inform us about the complaint by phone, e-mail or correspondence. Send the goods to our address and state the reason of the claim in the consignment. Complaints, including the removal of defects, must be settled without undue delay, no later than 30 days from the date of the claim, unless the supplier and the buyer agree on a longer period. After the expiry of this period, the Buyer shall be granted the same rights as if it were an irremovable defect.

The time limit for handling complaints is suspended if the seller has not received all the documents necessary for the settlement of the complaint (goods or its parts, other documents, etc.). The Seller is obliged to request completion of documents from the Buyer in the shortest possible time. The period is suspended from this date until delivery of the requested documents by the Buyer.

6.1.2 Acceptance of the settled claim

The complainant is obliged to pick up the item at the latest within one month of the expiry of the time when the repair or modification should have been carried out and, if later, within one month of the notification of its performance. If he fails to do so, he shall be obliged to pay the storage fee similarly as stipulated in §2159 of Act 89/2012 Coll. The fee is CZK 99 for each additional day of storage of the item after the expiry of the period of 30 days from the call for takeover of the item. If a storage fee has been charged, the item will be delivered to the customer only after the storage amount owed has been settled.


6.1.3 Settlement of disputes without a court

In the event of a dispute between the buyer (consumer) and the seller, the buyer may also avail himself of the out-of-court settlement of the dispute. In such a case, the buyer may contact the out-of-court dispute resolution entity, which is the Czech Trade Inspection (www.coi.cz) and proceed according to the rules specified therein. More information on extrajudicial dispute resolution can also be found on the website of the Czech Trade Inspection Authority (http://www.coi.cz/cz/spotrebitel/prava-spotrebitelu/mimosoudni-reseni-spotrebitelskych-sporu-adr/). Alternative dispute resolution is also available through the online form at https://webgate.ec.europa.eu/odr/.

7. Withdrawal from the contract - return of goods

In the case of goods purchased through the e-shop, the buyer - non-entrepreneur - natural person has the right to return the goods without giving a reason within 14 days from the delivery (collection) of the goods according to the Civil Code (§§ 1829 - 1837). Goods must be eligible for resale. The goods must not be damaged in any way, bear any signs of use or otherwise impaired and must be packed in original undamaged packaging together with all accessories. The goods must be accompanied by all documents. Goods that are subject to withdrawal from the purchase contract (returned goods) must be delivered to the postal address no later than 14 days after sending notice of withdrawal from the purchase contract, unless it was sent together with the notice of withdrawal. If this time limit is not met the right to withdraw from the purchase contract expires. Ship the goods as a registered shipment (eg: hand bag or recommended package) so that the shipment can be claimed if it is lost or damaged. Our online store assumes no liability for damage resulting from insufficient or no insurance or packaging of goods during shipment from the customer. Do not send the shipment with COD - shipments sent by COD customers will not be accepted by Blue Engineering s. r. o. If the conditions for withdrawal from the purchase contract are fulfilled on the part of the customer, a financial settlement will be made within 14 days. In accordance with Act No. 89/2012 Coll. § 1834 the customer is not entitled to a refund for the services provided to him in connection with the shipment of goods (eg cash on delivery, etc.) because these services were fully realized before withdrawal from the contract based on the customer's explicit wish expressed by sending the order . Pursuant to Section 1832 (2), the customer is not entitled to a full refund of the delivery price unless he has chosen the cheapest method of delivery. In such a case, the seller will pay the customer the price of the cheapest delivery method provided by the seller. The consumer cannot withdraw from a contract for the supply of goods in a sealed package which the consumer has removed from the package and cannot be returned for hygiene reasons. Goods cannot be returned within 14 days without giving a reason if the buyer was either a legal entity or a natural person doing business. Shipped goods, which are not subject to legal conditions for withdrawal from the purchase contract, will be returned to the customer after payment of the freight by the customer by bank transfer to the bank account of Blue Engineering s. r. o. §2159 of Act 89/2012 Coll. The fee is CZK 99 for each day of storage. The fee is charged for each day after the expiry of the period of 30 days from the request for payment of the transport until the payment or settlement of another customer's debt that prevents the dispatch of the thing. If a storage fee has been charged, the item will be sent to the customer only after the storage amount owed has been settled.

8. Protection of personal data

8.1 Categories of recipients / recipients of personal data

The Administrator undertakes not to disclose the Buyer's personal data to entities other than the following processors / entities:

(a) to a contractual carrier chosen by the buyer in the order form for the supply of goods, the information to be provided in the following extent: name, surname, address, e-mail, telephone number;

b) public authorities and state power

8.2 Data storage time

Personal data will be stored by the administrator for the period necessary to fulfill the contract (order processing, picking and delivery of goods) and for the duration of the statutory warranty (24 months from receipt of goods) or during the period of contractual warranty.

The buyer acknowledges that the administrator is obliged under § 31 of the Act on Accounting (No. 593/1991 Coll.) To keep accounting documents and accounting records (invoices) for at least 10 years beginning at the end of the accounting period to which they relate (ie, if you purchase goods during 2020, the invoice must be retained until at least the end of 2031). The administrator is also obliged under Section 47 of the Act on Administration of Taxes (No. 337/1992 Coll.) To keep the invoice for a period of 3 years from the end of the tax period in which the invoice related tax arose (that is, In the course of 2020, the invoice must be kept for tax purposes until the end of 2023). The invoice contains the following personal information: first name, last name, address, telephone number, contact e-mail.

8.3 Buyer's rights in relation to personal data

The Buyer further acknowledges that under Articles 15 to 21 of the GDPR has the right to:

1. access to personal data consisting of the right to obtain from the controller the confirmation whether or not personal data relating to him are being processed and, if so, he has the right to access such personal data and the information defined in Article 1; 15 GDPR;

2. to correct inaccurate personal data concerning him further taking into account processing purposes, the buyer has the right to complete incomplete personal data, including by providing an additional declaration pursuant to Article 16 of the GDPR;

3. a deletion ('right to be forgotten') consisting in the controller deleting without undue delay personal data concerning the buyer as soon as it is no longer needed for the purposes of the performance of the contract, unless there are other legal grounds for further processing or preservation;

4. to limit the processing of personal data in the cases defined in Article 18 of the GDPR;

5. the portability of data under the terms of Article 20 of the GDPR;

6. to object to the processing of personal data under Article 21 of the GDPR.

In any case, the administrator shall provide the buyer, upon request, with information on the measures taken within 15 days of receipt of the request.

The Administrator undertakes to provide the Buyer free of charge, in addition to the first copy of the processed personal data, a free second copy if the Buyer requests it, if he / she exercises his / her right of access to personal data.

The Seller shall allow the purchase without registration, using the data of unregistered buyers exclusively for the performance of the subject of the contract, not for marketing or business purposes, unless the buyer does not consent to it.

9. Responsibility for data accuracy

Blue Engineering s. r. o. notes that the information on the website is partially taken from third parties and may contain factual and technical inaccuracies or typographical errors and may be updated without prior notice. Therefore, the Company cannot guarantee the correctness of their content. Blue Engineering s. r. o. is not liable to any other party for damages caused by the use of information from the e-shop or linked websites, unless such information was subsequently confirmed in writing by the e-shop upon customer's request.


10. Courier delivery in the Czech Republic

The shipment will be delivered by courier service to your designated place (possibility to send a shipment to work - do not forget to give the name of the company) usually the next day after the day of dispatch between 8:00 am to 6:00 pm. the possibility of a third party, ie the carrier, and will be extended proportionately to the circumstances if the delay is due to force majeure or other circumstances not caused by the seller. Cash on delivery orders, if the ordered goods are in stock, are dispatched no later than the next working day after receipt of the order. Orders paid by bank transfer or card payment are dispatched no later than the next business day after the amount is credited to the account. Payment upon receipt of the consignment in cash - cash on delivery or prepay by bank transfer (free of charge). Package storage time: as agreed with the courier - maximum 3 delivery attempts or week.

11. Shipments abroad

We routinely ship goods to all EU and non-EU countries. Shipping costs are calculated based on weight, size and destination. Upon agreement, the shipment is sent either by courier or by post. International orders can only be paid by prepay - payment to a bank account or a credit card online to Blue Engineering s. r. o. - see Article 12. Prepayment. The price will be specified on the basis of further communication, so do not transfer the price of the goods until the final price has been confirmed.

12. Prepayment - payment to bank account

Orders delivered by the carrier (courier service) can be paid by transfer to a bank account of Blue Engineering s. r. o. Orders can be paid by credit card on the Internet.

13. Written information and instructions pursuant to Section 1820 of Act 89/2012 Coll.

- ad a) We do not charge any costs when using means of distance communication.

- ad f) If the contract was concluded using the means of distance communication, the consumer has the right to withdraw from the contract without stating a reason and without any sanction within 14 days of receipt of the performance. Pursuant to paragraph 7, the consumer shall not be entitled to withdraw from contracts for the supply of goods adapted to the consumer's wishes or for himself, as well as goods which are perishable, worn or obsolete.
